Any program produced and completed by this agency is subject to 10 % of gross amount. Since there is considerable effort and cost to building and delivering a sponsorship program, there are no refunds offered for retainer fees. There are no guarantees neither written or implied for the success of any marketing program. |

If information needs to be given to a potential sponsor, we will make the decision on a need to know basis and will consult with you before any information is released. This agreement entered into on this day is between the parties of ____________(Your Team Name) ____________________ Hereby and further known as the client or team and Sportsman’s Racing Solutions. hereby further referred to as the agency. Both parties must agree to and have a duly designated representative sign this agreement prior to the release of any marketing program. The agency also agrees that attached to this agreement, is a proprietary clause, which states that the agency will not release any financial information or other confidential team information other then to potential sponsors, without the express written consent of the team owner. It is the agency commitment to search and attempt to secure sponsorship for the client. This is done through research, contact, and negotiations and contract review. It is also the obligation of the agency to work with the marketing department and / or individual of a potential sponsor / marketing partner to devise and implement a marketing strategy to produce a measurable increase (ROI Return On Investment) for the product and services of the sponsor. The agency will advise the potential sponsor of the best medium to increase their market share and promote products at different venues that the race team is present. The agency will also be responsible for joint press releases between the sponsor and race team and will assist the sponsor in creating a viable promotional program for off site sales using the race team and it’s contestants. The race team will offer and provide a hold harmless clause to a potential sponsor that will protect the sponsor’s assets. Since racing is considered a hazardous sport, the team will assure the sponsor the following: If an accident should occur resulting in injury or death of a participant, contestant, spectator, track official or any other person, those persons involved cannot hold fault of the sponsor, the company employees, the company assets or any present and future holdings of the sponsor. The sponsor will be not held liable for any unforeseen events at the race track, while the team is in transport or while team is at the home work location. The sponsor will not be held liable for any death or injury to any circumstance including mechanical failure and subsequent destruction of the race car and /or equipment or any injury or death brought about by the lack of driver control in the pit area or racetrack. The sponsor will also be not held liable for any motor vehicle accident that may result in injury or death caused by the transporter or racecar hauler. Sportsman’s Racing Solutions will represent the client in a professional manner and the client is at liberty to dismiss the agency if they feel the agency is not working in their best interest. The agency can also terminate this agreement if the management feels that the race team has a negative result on the sport of auto racing. The agency will receive 10% commission for any revenue generated through, or result of any program delivered and negotiated. This does not include money generated by the race team through it’s own contacts and previous resources and contacts the agency will not receive any commissions or other expense reimbursement unless it produces sponsorship for the team. For example: If a sponsor paints your transporter with their name and logo and it cost $ 5,000.00, you need to be assured that they will return it to the original color if the sponsorship deal is not renewed. If they tell you to remove their name and logo, at the end of the term, you maybe looking at a big expense you shouldn’t have .We write this in for you. Also, is an insurance policy to protect the sponsor from any civil suits brought about by any volunteer crewmembers you have that may get hurt and not be able to return to work after an event. |
